Preamble
L' Hostellerie Cèdre & Spa - Beaune (hereinafter referred to as "the Hotel") is a hotel offering accommodation and well-being services. It is subject to the provisions of the French Tourism Code.
L' Hostellerie Cèdre & Spa - Beaune is a société par actions simplifiée unipersonnelle with capital of €800,000, registered in the Dijon Trade and Companies Register under number 847 498 169, with its head office at 10-12 Boulevard Maréchal Foch, 21200 Beaune.

These general terms and conditions of sale (hereinafter referred to as the "GTCS") apply to all bookings made on or afterOctober 1,2024.
Article 1 - Definitions
The terms and expressions referred to hereinafter, when preceded by a capital letter, for the purposes of the interpretation and performance hereof, shall be defined as follows:
- " Acknowledgement of receipt": e-mail sent by the Hotel or generated by the website to the Customer summarizing the reservation made by the Customer, and confirming its receipt by the Hotel.
- Conditions of sale of the reserved fare": specific conditions of each reservation, made by the Customer, relating to the payment of the reservation, the modifiable/non-modifiable or cancellable/non-cancellable nature of the reservation.
- " Reservation confirmation": e-mail sent by the Hotel summarizing the characteristics of the reservation, the room category, the extras included (breakfasts, etc.) and by which the Customer may enter his/her credit card number in the case of prepayment or a guarantee. Acceptance of the booking confirmation is binding on the Customer.
- Customer":natural person acting for purposes that are not part of his or her commercial, industrial, craft, liberal or agricultural activity.
- " Partners":service providers such as tour operators, travel agencies and online booking sites other than the Hotel.
- " Online reservation": reservation of hotel rooms using the online reservation form on the Site or by e-mail.
- " Service":reservation of accommodation, the essential characteristics of which are presented on the Hotel Site.
Article 2 - Purpose
The General Terms and Conditions govern the rights and obligations of the parties for any reservation of accommodation, restaurant or spa services made remotely or directly at the Hotel.
Article 3 - Scope and consent
The General Terms and Conditions apply to all bookings made on the website, by telephone or directly at the hotel.
Consent to the GCS is given by the Customer when validating the reservation.
The customer benefits from specific rights as a consumer making a reservation for his/her personal needs. These rights would be jeopardized if the reservation were made in the context of a commercial, industrial, artisanal, liberal or agricultural activity.
The Customer declares that he/she has full legal capacity to enter into these GTC.
Consent to the GCS is given at the time of Booking. The Customer acknowledges having read and accepted these terms and conditions before validating his/her reservation on the establishment's website and/or on other online reservation platforms.
In the absence of proof to the contrary, the data recorded in the Hotel's computer system constitutes proof of all transactions concluded with the Customer.
In accordance with the French Data Protection Act of January 6, 1978, reinforced and supplemented by RGPD (General Data Protection Regulation) which came into force on May 25, 2018, the Customer has, at any time, a right to access, rectify, oppose, delete and port all of his personal data by writing, by post and providing proof of his identity, to the following address:

Article 4 - Duration
The General Terms and Conditions of Sale are applicable for the duration of the Hotel's online services.
Article 5 - Enforceability of the GCS
The version of the general terms and conditions applicable to the Customer is that in force at the time of booking on the Hotel's website and/or via the Hotel's Partners.
Article 6 - Reservation
6.1 Customer choice
The Customer chooses the services presented on the Hotel's website.
He/she acknowledges that he/she has taken cognizance of the nature, purpose and reservation terms of the services available on the Hotel's or its partners' website and that he/she has requested and obtained the necessary and/or additional information to make his/her Reservation with full knowledge of the facts.
The Customer is solely responsible for his or her choice of services and their suitability for his or her needs, such that the Hotel cannot be held liable in this respect.
The reservation is deemed to have been accepted by the Customer at the end of the reservation process as defined in article 7 of the GTC.
6.2 Types of booking
The hotel offers rooms and suites, a restaurant and access to spa services. Reservations can be made directly via the website or through partners (travel agencies, tour operators).
Article 7 - Booking process
7.1 Reservations
Reservations are deemed to have been made as soon as the customer receives confirmation by e-mail.
Prior to any reservation, the Customer undertakes to complete the information requested on the reservation request. The Customer attests to the truthfulness and accuracy of the information provided.
The customer must provide a valid credit card as a guarantee, and a pre-authorization will be made one week or 14 days before arrival (depending on the rate selected, see 11.2).
The Customer agrees to these General Terms and Conditions.
7.2 Partners
Bookings via partner websites are also subject to the GTC, although cancellation conditions may vary depending on the partner.
7.3Groups
Any reservation of 5 rooms minimum, via our website, telephone, e-mail, agency or partner site (Booking, Expedia, ...) may be considered as a group and will be processed by our sales department. Group conditions and fees inherent to this type of request may be applied according to the contract sent by our sales department.
Under no circumstances will we be able to claim, a posteriori, pricing, payment, modification or cancellation conditions identical to an individual booking and different from those validated with our sales department at the time of the group booking.
Article 8 - Acknowledgement of reservation
The Hotel acknowledges receipt of the reservation by sending a summary e-mail to the Customer.
In the case of online reservations, the Acknowledgement of Receipt of the reservation by e-mail summarizes the contract offer, the services reserved, the prices, the conditions of sale, modification and cancellation relating to the selected rate, accepted by the Customer, the reservation date and the Hotel's contact details.

Article 10 - Modification or cancellation of reservation
10.1 No right of withdrawal
In accordance with article L. 221-28 of the French Consumer Code, the Customer has no right of withdrawal.
10.2 Modifications and cancellations
When price conditions permit, the Customer may cancel or modify the reservation in accordance with these conditions, by contacting the Hotel directly by telephone or e-mail.
Cancellation or modification fees vary according to the time between cancellation and the start of the booked stay, the rate booked and the booking method (by e-mail, the hotel's website, a partner website such as Booking.com or Expedia, agency, etc.).
The terms and conditions for modifying or cancelling the Reservation are stipulated on the reservation confirmation e-mail received by the Customer once the reservation has been made and according to the reservation method.
In the event of a deposit, and depending on the cancellation conditions, the amount paid will be refunded after deduction of cancellation fees (except for non-cancellable and non-refundable offers).
10.3 Interruption of stay
In the event of interruption of the stay due to the customer's fault, the entire agreed price will be cashed.
In the case of pre-paid bookings, no refunds will be made.
Article11 - Hotel stay
11.1 Check-in and Check-out
On arrival at the Hotel, the Customer will be asked to complete an identity form and provide proof of identity.
Check-in and check-out at the hotel reception.
Check-in: from 4pm on the day of arrival.
Check-out: until 12 noon on day of departure.
If the check-out time is not respected, the Hotel reserves the right to charge an additional night.
We recommend that you use the " Comments or additional information" box on the booking form to inform us of your estimated time of arrival.
Reception is open 24/7.
Upon arrival, the entire stay is due and payable.
11.2 Deposit and payment conditions
Payment for the stay and any extras is due, at the latest, on departure.
A pre-authorization equivalent to the first night's stay will be made one week before arrival, to cover any additional costs or cancellations.
For "Long Stay" offers, a pre-authorization of an amount equivalent to50% of the total amount of the reservation will be made 14 days before arrival, in order to cover any additional costs or cancellations.
For "Event" rates, such as the Beaune Wine Sale, the full amount of the reservation is due 30 days prior to arrival. Any extras will be billed on site and settled on departure.
11.3 In the bedroom
Pets are allowed in the hotel and in the room, and are charged €30 per night and per pet.
The Customer accepts and undertakes to use the room in good manners. Therefore, any behavior contrary to good morals and public order will lead the Hotel to ask the Customer to leave the establishment without any compensation or refund if payment has already been made.
In the event of damage, loss, breakage or theft, the amount will be charged to the credit card that was left as a guarantee at the time of booking.
In accordance with current legislation and for the comfort of all our guests, smoking is strictly prohibited in hotel rooms and indoor areas. Any breach of this rule will result in additional charges.
In the event of non-compliance with this prohibition, we reserve the right to charge the customer the amount corresponding to the number of nights during which the room must be closed for intensive cleaning and deodorization, until it can be rented again.
11.4 Hotel behavior
The Customer undertakes to use the Hotel's facilities in accordance with the rules of decorum. Inappropriate behavior may result in immediate expulsion without refund.
Article12 - Liability
12.1 Photographs
The photographs presented on the Hotel's website or those of its partners are for information purposes only. The photographs are intended to give as accurate an idea as possible of the services offered.
However, variations may occur, notably due to changes in furniture or renovations.
What's more, not all rooms are the same.
12.2 Non-fulfilment of reservation
The Hotel cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, the act of a third party, unforeseeable and insurmountable, the act of the Customer, in particular the unavailability of the Internet network, impossibility of access to the website, external intrusion, computer viruses or in the event of unauthorized prepayment by the bearer's bank.
Under no circumstances may the Hotel be held responsible for "exceptional and unavoidable" circumstances within the meaning of article L.211-16 of the French Tourism Code, such as war, terrorist attacks, riots, epidemics, pandemics, cyclones, tsunamis, or for reasons relating to the safety of travellers or an injunction from an administrative authority.
Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for any reason attributable to the Customer will result in the cancellation of the order at the Customer's expense, without prejudice to any civil or criminal action against the Customer.
12.3 Partner services
Partners are responsible for promoting offers on their own websites, mobile services and/or any other tools used to access the Hotel website.
Article 13 - Complaints
Complaints relating to the non-performance or poor performance of hotel services must be notified to the Hotel in writing within eight days of the date of departure from the Hotel to the Customer Service contact details indicated in article 9.
Article 14 - Prices
14.1 Price indication
Prices for booked services are indicated before and at the time of booking. Prices are per room for the number of person(s) and date selected.
Prices are confirmed to the Customer in euros and are valid only for the period indicated on the Hotel's website.
All bookings are payable in euros.
Unless otherwise stated, additional services (breakfast, cleaning, personal welcome) are not included in the price.
14.2 Taxes
The tourist tax is in addition to the rate indicated at the time of booking. The current rate is set by the commune.
Prices include VAT applicable on the date of the order, and any change in the VAT rate will be automatically reflected in the prices indicated on the date of invoicing.
Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the prices indicated on the date of invoicing.
Article 15 - Payment
15.1 Guarantees
The Customer provides his bank details as a guarantee for the reservation, i.e. the card number, its date of validity (it is specified that the bank card used must be valid at the time of the stay) and the cryptogram, via the means that comply with the regulations in force for electronic payment transactions.
A bank pre-authorization or payment according to the selected rate (see 11.2) will be made prior to arrival in order to definitively guarantee the customer's reservation.
They must present themselves at the hotel with the credit card used to guarantee the reservation or make the prepayment.
15.2 Extras
Additional costs, such as catering, bar or spa treatments, must be paid directly to the hotel.
Article 16 - No show
A no-show is a situation in which a Reservation has not been cancelled and the Customer is not present.
The Hotel will debit the Customer for 100% of the reservation. In addition, the Reservation will be considered cancelled for the remainder of the stay from midday (12 noon) on the following day of the initially scheduled arrival date, unless the Customer informs the Hotel to the contrary.
In the case of online prepayment, the deposit is debited at the time of booking.
These provisions apply both to bookings made directly and to bookings made on the Hotel's partner platforms.
Article 17 - Relocation
In the event of an exceptional event or the impossibility of making the reserved room available to the Customer, or in the event of force majeure, the Hotel reserves the right to accommodate the Customer in whole or in part in a hotel of an equivalent category, for services of the same nature and subject to the Customer's prior agreement.
Any additional costs for the room, transport between the two hotels and a telephone call will be charged to the hotel.
Article 18 - Force majeure
Force majeure is defined as any unforeseeable, insurmountable event external to the parties, which prevents either the Customer or the Hotel from fulfilling all or part of its obligations under the contract.
Cases of force majeure or fortuitous events are those usually recognized by the jurisprudence of French courts.
Each party shall not be liable to the other party in the event of non-performance of its obligations resulting from an event of force majeure. It is expressly agreed that force majeure suspends, for the parties, the performance of their mutual obligations, and that each party shall bear the costs arising therefrom.
Article 19 - Settlement of disputes and applicable law
The law applicable to the contract is French law.
The Hotel hereby informs the Customer of the possibility of resorting to a conventional mediation procedure or any other alternative dispute resolution method in the event of a dispute relating to these general terms and conditions, in accordance with the conditions set out in Title I of Book VI of the French Consumer Code.
After the Customer and the Hotel have attempted to resolve the dispute amicably, and in the event of a negative response or the absence of a response within sixty (60) days from the date of referral, the Customer may refer the matter to the Tourism and Travel Ombudsman, whose contact details and referral procedures are available on his website: www.mtv.travel.
Article 20 - Storage and archiving
The Hotel shall keep the written record of the conclusion of the contract for an amount equal to or greater than one hundred and twenty (120) euros for a period of three (3) years from the conclusion of the contract until the provision of services, and shall guarantee access to it at any time during the same period.
Contractual documents will be kept in electronic or paper format.
Article 21 - Protection of personal data
In application of law 78-17 of January 6, 1978 amended by law n°2018-493 of June20, 2018, it is reminded that the personal data requested from the Customer is necessary for the processing of his/her Reservation and the establishment of invoices, in particular.
This data may be communicated to any of the Hotel's partners responsible for executing, processing, managing and paying for orders.
The processing of information communicated via the www.cedrebeaune.com website complies with legal requirements for the protection of personal data, and the information system used ensures optimum protection of this data.
In accordance with current national and European regulations, the customer has a permanent right of access, modification, rectification, opposition, portability and limitation of the processing of information concerning him/her.
This right may be exercised in accordance with the terms and conditions set out on the www.cedrebeaune.com website.
